What Is Arbitration?
Are you looking for an alternative to the court system to settle your conflict? Arbitration is an alternative dispute resolution process to use instead of the court system. Many times arbitration is used when the mediation process wasn’t successful.
Arbitration costs less & is less time consuming than litigation and court proceedings. In arbitration, individuals can present their case face-to-face, online, or in writing.
What happens in arbitration?
When people choose arbitration to resolve conflict, they are choosing a process that, in some ways, is similar to going to court. Arbitration is a less formal way to tell your side of the story. Each person presents their case in front of a “judge,” testifying & calling witnesses if they chose to. It may last 1-2 hours.
What is an arbitrator's roll?
The “judge” is called an arbitrator. The arbitrator is impartial & will evaluate the information then make a written decision. The decision usually favors one party. An arbitrator can be lawyer or a person specifically trained as an arbitrator. Arbitrators that are not lawyers do not give legal advice.
